Agreement
These Terms govern access to and use of Kusmol’s payment failure classification and recovery-routing service (the “Service”) by businesses and their authorized users (“Merchant,” “you”). By using the Service, you agree to these Terms.
The service
Kusmol analyzes failed payment attempts and returns a failure classification, a confidence level, and recommended recovery options. The Service is decision-support infrastructure: it does not process, hold, or move funds, and it is not a licensed money transmitter or payment processor.
Third-party payment processors
Any actual movement of funds, retries, or recovery actions taken as a result of Kusmol’s recommendations are executed through your own payment processor(s), acquiring banks, or other financial infrastructure providers. Kusmol is not responsible for the performance, availability, or decisions of those third parties.
AI-generated recommendations
Failure classifications, confidence levels, and recovery recommendations are generated using automated and machine-learning based methods applied to the data you provide. These outputs are probabilistic recommendations, not guarantees. Confidence levels reflect the model’s relative certainty and are not a statement of expected outcome. You are responsible for deciding how, and whether, to act on any recommendation.
No guaranteed results
Kusmol does not guarantee that any specific payment will be recovered, that any recovery rate will be achieved, or that any particular classification is correct. Outcomes depend on factors outside Kusmol’s control, including the behavior of issuing banks, card networks, and payment processors.
Payment data and security
You are responsible for ensuring that any data you send to Kusmol is transmitted lawfully and, where applicable, in accordance with your obligations under card network rules and data protection law. Kusmol applies technical and organizational safeguards to protect data submitted to the Service, as described in our Privacy Policy.
Acceptable use
You agree not to misuse the Service, including by submitting data you are not authorized to share, attempting to reverse engineer our classification models, or using the Service in a way that violates applicable law or card network rules.
Disclaimers
The Service is provided “as is” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, or fitness for a particular purpose. Kusmol does not warrant that the Service will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, Kusmol will not be liable for indirect, incidental, or consequential damages, including lost revenue or lost payments, arising from use of the Service.
Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
